Promise of Sale Agreement (Konvenji) & Deed of SaleOnce you, as a prospective buyer, have found the immovable property to be purchased, the next step is to enter into a promise of sale agreement (konvenju). The purchaser has the right to choose his or her own notary. At this point the parties are asked to provide certain information and documents, including their identity cards and contract of acquisition of the property being purchased. The purchasers will be provided with a quote for notary fees and expenses, and any tax due. At konvenju stage, a deposit is paid by the purchaser in favour of the seller, the practice being 10% of the total price (unless parties agree otherwise). Once the promise of sale agreement is signed and registered, the notary will then carry out the required searches and, if they result to be in order, proceed to publish the final deed. In the case of foreigners, the notary will apply for a special permit. Once the final deed is published, the notary is bound to register it within 15 working days and provide a copy to the parties.

Wills & Declarations Causa Mortis (Successions)There are various advantages of having a will. Through a will, it is possible to dispose of your property (whether movable or immovable) as you please. Without a will, the notary will have to file an application in court for the opening of succession, whereby the court will eventually verify the heirs at law.
When a person passes, his/her heirs inherit any property held by the deceased. The notary will carry out testamentary searches in order to verify whether a will has been left by the deceased. Once the heirs are established, the notary will publish the declaration Causa Mortis wherein the heirs need to declare any immovable property held by the deceased. The heirs can also ask the notary to check for any monies/investments held by the deceased and the notary will arrange for the necessary disbursements of such assets accordingly. |
